These Storefront Terms of Use ("Terms") govern your use of any online store powered by Maketio and any purchase you make through such a store. The Maketio platform is operated by Ing. Jakub Havej, a sole trader (OSVČ) registered in the Czech Republic, IČO 01491563, Lužice 115 435 24 ("Maketio", "we", "us").
By browsing a Maketio-powered store or placing an order, you ("you", the "Buyer") agree to these Terms.
Important: who you are buying from
The seller is the Merchant, not Maketio. Maketio provides the technology that runs the store and the checkout. The Merchant — the creator or business whose store you are buying from — is the seller of record and is solely responsible for the products, product descriptions, pricing, order fulfilment, shipping, returns, warranties, and customer service. Maketio is not a party to your purchase contract and does not sell, stock, or ship the products.
1. Definitions
- Store — an online store operated by a Merchant using the Maketio platform.
- Merchant — the creator or business that operates a Store and sells products through it.
- Maketio — the operator of the platform, as identified above.
- Buyer — you, the person browsing a Store or placing an order.
2. Eligibility
You must be at least 18 years old to place an order.
3. The platform service
Maketio provides Merchants with hosting, storefront tooling, and a checkout that
runs through Stripe. We do not control a Merchant's product range, prices,
availability, or fulfilment. Stores may run on a maketio.com subdomain or on a
Merchant's own custom domain.
4. Your purchase
- Your contract of sale is formed between you and the Merchant. The Merchant sets prices, availability, product information, and delivery terms.
- Your purchase is subject to the Return & Warranty Policy, which sets out your statutory rights (including, for consumers in the EU, the right of withdrawal and the legal guarantee of conformity) and how to exercise them.
- Nothing in these Terms limits any mandatory consumer rights you have under the law of your country of residence.
5. Payments
Payments are processed by Stripe. The Merchant is the merchant of record. Maketio does not receive or store your full card details. By paying you also agree to Stripe's applicable terms.
6. Acceptable use
You must not use a Store or the platform to break the law, infringe others' rights, submit false information, attempt to disrupt or gain unauthorized access to the platform, or misuse the checkout.
7. Your privacy
Personal data you provide at checkout is handled as described in our Privacy Policy. For Buyer data, Maketio and the Merchant are joint controllers; you can exercise your data-protection rights, and request deletion, as set out in the Privacy Policy and the Data Deletion Instructions.
8. Intellectual property
Store content (product names, images, descriptions) belongs to the Merchant or its licensors. The platform itself, including Maketio's software and trademarks, belongs to Maketio. Nothing here grants you rights in either beyond using the Store to make a purchase.
9. Disclaimers and liability
- The platform is provided "as is". Maketio is not responsible for the products, their quality, safety, or delivery — those are the Merchant's responsibility.
- To the extent permitted by law, Maketio's liability to you for the operation of the platform is limited; this does not limit and does not affect your statutory rights or claims against the Merchant as seller.
- Complaints about a product, an order, a return, or a warranty should be directed to the Merchant in accordance with the Return & Warranty Policy.
10. Consumer dispute resolution
If you are a consumer, you may be entitled to out-of-court dispute resolution in relation to your purchase. For matters concerning the seller you should contact the Merchant first; you may also use the competent consumer body in your country of residence, or the EU ODR platform.
11. Governing law
These Terms, insofar as they govern your relationship with Maketio regarding use of the platform, are governed by the law of the Czech Republic, without prejudice to the mandatory consumer-protection law of your country of residence. Your contract of sale with the Merchant is governed by the terms and law applicable to that Merchant.
12. Changes
We may update these Terms from time to time; the version in force is the one posted here when you use a Store or place an order.
